Rental Terms and Conditions

Pricing & Payment terms
Reservation of a Machine is confirmed with a Purchase Order number and Proof of Payment.
No machine will be delivered to any client or site without proof of payment.
The machine will only be pre-delivered subject to availability.
A daily charge will apply should the delivery be required a day before actual use.
This Quotation is valid for 30 days and is subject to availability.
A 100% cancellation fee applies 48 hours prior to the order date.
No refund if the Machine is delivered and not used.
If a Machine cannot be delivered due to an Accident, strike or Machine failure, the supplier will reimburse the rental or portion of
that.
When the rental is more than 1 month, then a 50% Deposit and 1 month rental payment upfront is required before delivery.
When daily or weekly rental, payment needs to be paid before delivery of the machine.
Overtime: when the rental is extended agreed time an hourly rate will be charged.
Pressure plates have to be ordered if the site is uneven, in loose sand, soft ground or is on a slope at an additional cost of R150 ex VAT each Surcharge of
R1500 will be charged if the machine is hired on Sundays or public holidays.
Operator Notes for Telehandler only
a. Client is responsible for the operator’s accommodation on site if applicable. Transport to and from the site is to be supplied by Hirer.
b. Site-specific medicals and induction to be supplied by and be for the account of the Hirer.
c. A valid training certificate and medical certificate will be required should the Customer elect to use its own operator
Site Supervision
a. Where an operator is provided by Lift Up, the hirer is obliged to provide suitably qualified supervision of the Telehandler and
it’s operator at all times whilst on site to direct the operator/s in the movement and lifting operations and to carry out all
necessary securing of goods that are required to be lifted or moved.
b. The hirer is responsible for ensuring that the Operator is included in and made aware of all appropriate site safety
requirements.
c. The hirer shall be responsible for all the acts and/or omissions of the owner’s operator while under the hirer’s control
supervision and instruction. The operator will warn the Hirer if the machine works out of its limit. If the hirer instructs to continue beyond the operator’s warning the hirer is
responsible for any loss, damage, injury or death.
Rental Rate Notes
a. Machines come with a dry rate: Diesel is for the customer’s account, should the hire period exceed 1 day. Machines are delivered with a full
tank and should returned full. b. No Rigging is provided.
c. It remains the customer’s sole responsibility to ensure that the machines on hire are operated at all times by certified
operators only. A copy of a valid Operating license and medical certificate is to be provided.
d. Hire period to commence on collection of unit and to end on return of the unit to Lift Up Culemborg Yard in Cape Town.
e. Where a monthly rate has been quoted on a 5-day work week, Monday to Friday, a 21 average work day month, this rate will
only apply in the case of hires that are 31 calendar days or more in duration.
Should the duration of the hire be shorter than one month, for any reason whatsoever (public holidays,
holiday close, due to bad weather) then the rate will automatically revert to a weekly hire rate (as indicated in the quote)
f. Where a weekly rate has been quoted and accepted this rate will only apply in the case of hires that are 5 calendar days or
more in duration. Should the duration of hire be shorter than calendar 5 days, for any reason whatsoever ( public holidays,
holiday close, due to bad weather) then the rate will revert automatically to a daily hire rate ( as indicated in the quote). g.
Where a daily rate has been quoted and accepted this rate will only apply at 8 hours per day.
h. No credits for break-downs will be considered unless the customer provides the company with a Breakdown Reference
Number issues to it upon the reporting of the breakdown. This does not apply if the fault is caused by the Operator.
i. Upon termination of the hire, the customer must notify the company. The customer should phone the office to obtain an
off-hire number and should retain this reference number. Without proof of an off-hire reference number, the equipment
will remain on hire for the customer’s account. Notwithstanding anything to the contrary herein contained should the unit
not be available for collection the hire period will continue until the unit is available for collection.
j. Kindly ensure that you have personnel on-site to sign for acceptance of our equipment (per the information contained in
our quote). In the event that you do not have personnel on-site to sign acceptance of the delivery documentation, the
equipment will be deemed to have been accepted by you from the date of delivery to you and the signature and proof
of delivery signed by Lift Up staff will be considered to be adequate proof of receipt by the customer, and the customer will be
liable for payment from that date and time.
k. Site Establishment will be invoiced in the 1st invoice period following on hire event of equipment to the site.
l. Equipment will not be despatched to you until such time that we are provided with a physical purchase order and signed
quote acceptance.
m. The customer has the obligation to store the equipment inside and in a secure location when the equipment is not used.
n. Each machine comes with one attachment, any additional attachments, subject to availability, will be charged. Attachments
ordered after delivery of the Machine are subject to availability and a delivery charge applies.
Damage Waiver Cover
a. Lift Up is able to affect damage waiver cover for the equipment only (excluding persons and goods on and in the
equipment) at a premium as specified per quoted item of the rental rate selected.
b. The deductible amount (excess) that you will be charged for in the event of any accident will be an amount equal to
15% of the damage with a minimum excess of R 8 000
c. Such cover is subject to the conditions as contained in our Standard Conditions of Hire.
d. The necessary comprehensive insurance of the rental equipment may be affected by yourselves in which case proof of
the existence of such insurance is to be submitted for acceptance by Lift Up prior to the hire.
e. In the event that the rental equipment is insured by yourselves, we would require that your policy be endorsed showing Lift
Up co-insured. Rental equipment is to be insured for an amount not less than the agreed market value per unit, which is
obtainable from Lift Up in writing on request.
f. Please note that in terms of the Financial Advisory and Intermediary Act No. 37 of 2002 of the Republic of South Africa, it is a
requirement that the damage waiver broker discloses various details about himself to our Clients.
g. In the event you require a copy of the policy schedule or need any explanation or advice please contact Lift Up.
Terms and Conditions
a. All equipment is hired out in terms of our General Terms and Conditions of Hire Agreement.
b. The equipment is deemed to be “On Hire” for the entire period and under no circumstances would they be ever
considered “For Sale”, ownership remains with Lift Up.
c. The property law of this contract will be the law of South Africa and the Parties agree to the jurisdiction of the High Court of
South Africa to hear and adjudicate on any dispute arising out of this agreement, notwithstanding that any course of action
may arise beyond that area of jurisdiction.
d. The quote is submitted for the hire of the plant solely to you for the above-mentioned proposal. No rights arising from
this quotation are transferable save with the written agreement and consent of Lift Up. e. Please return all hired equipment to
Lift Up in a clean state, and free from any damage.
f. Any repairs, additions or corrections required to bring the hire equipment back to its original hire condition, the condition it
originally went out on hire in, will be for the hirers account, fair wear & tear excepted.
g. Should there be any unseen objects which could cause damage to the machine to the machine tyres, the repair will be for the
hire account,
h. Any damage found on the machine must be reported to Lift Up before the use of the machine commences.
i. Any damage found after initial use, will be deemed the responsibility of the hirer.
j. Damage to the machine due to negligence, abuse, or misuse will be charged to the Hirer.
k. Traveling cost applies for service or any repairs on the machine if outside of Cape Town.
